The offer Agreement
**Limited Liability Company "V. P. Groshev Meshchersky Museum of Wooden Architecture"**, hereinafter referred to as **Museum**, represented by Director Tatyana Vladimirovna Grosheva, acting on the basis of the Charter, publishes this Offer Agreement (hereinafter referred to as the Agreement) about the sale of territorial tickets for visiting the Museum's territory (hereinafter referred to as Tickets) to individuals (hereinafter referred to as Visitors).
This Agreement is a public offer in accordance with Article 437 of the Civil Code of the Russian Federation.
**1. TERMS AND DEFINITIONS**
**Offer** This document is a public offer from the Museum addressed to any individual to conclude a ticket purchase and sale agreement with him on the terms contained in this Agreement, including all its appendices.
**Acceptance of the Offer** The Visitor's full and unconditional acceptance of the terms of this Agreement by performing the actions specified in clause 3.1 of this Agreement. Acceptance of the Offer means the conclusion of an Agreement between the Museum and the Visitor.
***Visitor*** any natural person who has accepted an Offer.
**Ticket** an electronic document confirming the Visitor's right to visit the Museum in accordance with the selected fare and during the specified period.
***The Museum's website** is the official website of the Museum, located at: https://muzeigrosheva.ru / .
***The territory of the Museum** is the territory where the cultural heritage objects that are part of the Museum are located.
***Tariff** the cost of visiting the Museum's territory set by the Museum for a certain category of Visitors. Information about the rates is available on the Museum's website.
**Payment system** A service provided by banks or other organizations for making payments over the Internet.
**2. SUBJECT OF THE AGREEMENT**
2.1. The Museum undertakes to transfer to the ownership of the Visitor a Ticket granting the right to visit the Museum's territory in accordance with the selected tariff, and the Visitor undertakes to pay the Ticket price in accordance with the procedure and terms stipulated in this Agreement.
2.2. The list of fares, Ticket prices, Museum opening hours and other conditions for visiting the Museum's territory are posted on the Museum's Website and are an integral part of this Agreement.
**3. THE PROCEDURE FOR CONCLUDING THE CONTRACT**
3.1. Acceptance of the Offer is the User's performance of the following actions in combination:
* Familiarization with the text of this Agreement posted on the Museum's Website.
Selection of the Ticket type (fare) and the number of Tickets on the Museum's Website.
* Filling in the required fields of the order form on the Museum's Website (Visitor's full name, contact phone number, email address).
* Select the payment method and the payment of the cost of Tickets through the Payment system.
3.2. The date of conclusion of the Contract is the date when the Museum receives confirmation of payment of the Ticket price from the Payment System.
3.3. After paying for the Tickets, an electronic confirmation (e-Ticket) is sent to the Visitor's specified e-mail address, containing information about the purchased Tickets, including the order number, date of visit (if applicable), fare and other necessary information.
**4. RIGHTS AND OBLIGATIONS OF THE PARTIES**
**4.1. The Museum undertakes to:**
* Provide the Visitor with the opportunity to visit the Museum's territory in accordance with the purchased Ticket and the Museum's opening hours.
* Provide the Visitor with information about the rules of visiting the Museum, posted on the Museum's Website and information stands on the Museum grounds.
* Ensure the safety of the Visitor's personal data in accordance with the current legislation of the Russian Federation.
**4.2. The Museum has the right:**
To make changes to the Museum's operating hours, tariffs for visiting the Museum, which notifies Visitors in advance by posting information on the Museum's Website.
* Deny the Visitor access to the territory of the Museum in the event of a breach of the rules of visiting the Museum, public order, and in the case of the provision of Visitor false information when making order.
* Cancel the Ticket in case of discovery of facts of its misuse.
**4.3. The Visitor undertakes to:**
* Read the terms of this Agreement and the rules for visiting the Museum posted on the Museum's Website.
* Provide reliable information when placing an order.
* Pay the Ticket price in accordance with the procedure and deadlines set forth in this Agreement.
Observe the rules of visiting the Museum, public order and take care of the exhibits and the Museum grounds.
Present an electronic Ticket (in printed or electronic form) when visiting the Museum.
**4.4. The visitor has the right to:**
Visit the Museum territory in accordance with the purchased Ticket and the Museum's opening hours.
* Receive information about events held by the Museum and changes in the Museum's operating hours.
**5. TICKET PRICE AND PAYMENT PROCEDURE**
5.1. The Ticket price is determined in accordance with the applicable rates posted on the Museum's Website.
5.2. Payment for Tickets is made by the Visitor in rubles of the Russian Federation through the Payment System.
5.3. The Museum is not responsible for failures in the Payment System.
**6. RESPONSIBILITY OF THE PARTIES**
6.1. The Parties shall be liable for non-fulfillment or improper fulfillment of their obligations under this Agreement in accordance with the current legislation of the Russian Federation.
6.2. The Museum is not responsible for any losses incurred by the Visitor as a result of:
* Misuse of the Museum's Website.
* Unauthorized access to the Visitor's personal data.
* Non-compliance by the Visitor with the rules of visiting the Museum.
6.3. The Museum's liability under this Agreement is limited to the cost of Tickets purchased by the Visitor.
**7. CIRCUMSTANCES OF FORCE MAJEURE (FORCE MAJEURE)**
7.1. The Parties shall be released from liability for partial or complete non-fulfillment of obligations under this Agreement if this non-fulfillment was the result of force majeure circumstances that arose after the conclusion of the Agreement as a result of extraordinary events that the Party could not have foreseen or prevented by reasonable measures.
7.2. Force majeure circumstances include, in particular, natural disasters, fires, floods, epidemics, wars, mass riots, strikes, decisions of government agencies, as well as other circumstances beyond the control of the Parties.
7.3. The Party referring to force majeure circumstances is obliged to immediately notify the other Party of the occurrence of such circumstances and their impact on the fulfillment of obligations under this Agreement.
**8. DISPUTE RESOLUTION**
8.1. All disputes and disagreements arising between the Parties under this Agreement shall be resolved through negotiations.
8.2. If it is impossible to resolve disputes through negotiations, they are subject to consideration in court in accordance with the current legislation of the Russian Federation at the location of the Museum.
**9. THE TERM OF THE CONTRACT AND THE PROCEDURE FOR ITS TERMINATION**
9.1. This Agreement comes into force from the moment of Acceptance of the Offer by the Visitor and is valid until the Parties fully fulfill their obligations.
9.2. This Agreement may be terminated prematurely by agreement of the Parties.
9.3. The Museum has the right to unilaterally withdraw from the performance of this Agreement in case of violation by the Visitor of the rules of visiting the Museum or other terms of this Agreement.
9.4. The Visitor has the right to refuse to perform this Agreement in accordance with the procedure and cases provided for by the current legislation of the Russian Federation. A refund is possible no later than three days before the date of the Museum visit indicated on the Ticket when contacting the Museum by e-mail, or in person at the museum's ticket office.
**10. OTHER CONDITIONS**
10.1. This Agreement, as well as information about the rates and rules for visiting the Museum, are posted on the Museum's Website and are publicly available.
10.2. The Museum has the right to make changes and additions to this Agreement at any time without prior notification to Visitors. Changes and additions will take effect from the moment they are published on the Museum's website.
10.3. The Visitor is responsible for timely familiarization with the amendments and additions made to this Agreement.
10.4. All issues not regulated by this Agreement are subject to resolution in accordance with the current legislation of the Russian Federation.
